1. Description of Service

nasimstg.dev is a portfolio website that also functions as a client portal for commissioning and managing web development projects. The services ("Service") include, but are not limited to:

• Browsing our portfolio and service offerings
• Creating a user account to manage projects
• Commissioning projects, which may be priced on an hourly or fixed-price basis
• Managing projects through a dashboard with milestones
• Communicating with us via an integrated instant messaging system
• Processing payments for services through our third-party payment processor, Lemon Squeezy

2. User Accounts

To access certain features of the Site, such as project management and messaging, you must register for an account. You agree to:

• Provide accurate, current, and complete information during the registration process
• Maintain the security of your password and accept all risks of unauthorized access to your account
• Promptly notify us if you discover or otherwise suspect any security breaches related to the Site

We use Firebase Authentication for account management. By creating an account, you agree to be bound by the terms of the Firebase service.

3. Payments, Billing, and Refunds

Payment Processing

All payments for projects, whether for single purchases or milestone-based payments, are processed through our third-party payment provider, Lemon Squeezy. We do not store or have direct access to your full credit card or payment information.

Pricing

Project prices will be agreed upon before the start of work. For fixed-price projects, milestones may be added to extend the project scope, which may incur additional costs.

Billing

You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site.

Refunds

Refund policies are determined on a per-project basis and will be outlined in your specific project agreement. Generally, work already completed is non-refundable.

4. User Conduct and Responsibilities

You agree not to use the Service for any unlawful purpose or in any way that interrupts, damages, or impairs the service. You agree to be responsible for all content you send through our messaging system. Prohibited actions include:

• Harassing, threatening, or defaming any person or entity
• Distributing spam, unsolicited or bulk electronic communications
• Transmitting viruses, worms, or any other malicious code
• Infringing on the intellectual property rights of others

We reserve the right to terminate your account and access to the Service without notice for any violation of these Terms.

5. Intellectual Property

Our Content

All content on the Site, including text, graphics, logos, and software, is the property of Md Nasim Sheikh or its licensors and is protected by copyright and other intellectual property laws.

Your Content

You retain ownership of any intellectual property you provide as part of a project (e.g., text, images, business data). You grant us a limited license to use this content for the sole purpose of completing the project.

Project Ownership

Unless otherwise specified in a separate project agreement, upon full payment for a project, you will own the final, delivered work. We retain the right to use the project in our portfolio for promotional purposes unless a non-disclosure agreement (NDA) is signed.

6. Disclaimers and Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

To the fullest extent permitted by law, Md Nasim Sheikh shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

7. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

You may terminate your account at any time by contacting us.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice before any new terms take effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of Bangladesh, without regard to its conflict of law provisions.
